One of the responsibilities of the President is the selection of justices to sit on the bench in our highest US court. The Supreme Court is the most senior job a US lawyer or judge can hope to attain. It is the final arbiter of all cases brought before our judiciary, the last stop in the appeals process, and a check-and-balance to the Executive and Legislative branches.
The Constitution set the Supreme Court as an appellate court and it could only be the initial court in cases involving ambassadors, ministers, consuls, and the states. Article three provides for the creation of the court, and other lower courts as Congress feels are needed. The use of the Supreme Court that is familiar to all of us was not established until 1803 in the case of Marbury v. Madison. The case involved a controversy regarding the installation of judges to various courts, but the result was the concept of Judicial Review, which gave the courts the ability to rule over actions of Congress or the Executive branch.
It is clear why the framers did not include Judicial Review in the Constitution. The nine people who sit in the Supreme Court have become the most powerful people in our country. They sit as the final authority on all cases, all legislation, and even elections that take place in the United States. They can, with the stroke of a pen, override the will of the people, as has been done several times in the lower courts in California. They can modify or “interpret” the Constitution, as was done in Roe v. Wade, a decision which found the right to an abortion to be somewhere in the Constitution. They can even cite previous “interpretations” of the Constitution to create new ideas and laws, thus completely changing the intent of the founders, as was done in Kilo v. City of New London where the fifth amendment and private property rights were nearly destroyed in favor of “public interest”. The justices on the Supreme Court have been set up as the kings and queens of America under the guise of a democratic process. Thus the appointments to the court have a significant impact on the shaping of our nation for many generations, as these powerful individuals serve until they choose to quit, or they die. Because they wield such power without any election of the people, they are our truly our nation’s monarchs.
So, B. Hussein has been given an opportunity to select someone for the Court due to the retirement of Justice David Souter. Dave is apparently tired of imposing his personal will and philosophy on the people of this nation and wishes to take a break before he dies. The criteria for his replacement has been rumored to be someone who “feels” and can artfully interpret the laws. What that really means is someone who will help the Socialists implement their agenda from the bench. The Judiciary is the only branch of government where, once appointed, the individuals remain in power without further election or review, so it enables an ongoing implementation of the liberal agenda. This is why our Socialist friends are so excited about this appointment. They can put someone on the court that, if unchecked, can perpetuate their liberal philosophies for decades.
All that being said, what should a Supreme Court Justice have as requirements? Are we looking for a Harriet Miers, with little or no judicial experience? If you remember Bush’s initial selection of Miers, it was lambasted by the Dems because she lacked experience. Now we’re told that experience on any court, no matter the level, should not be a factor in BHO’s pick. So what will our esteemed President use as a benchmark for selecting a new justice? Well, we’ve heard it must be a woman, so it is clear that gender is a factor. By the way, if someone said it must be a man, they would be called sexist.
They can’t be a racist, BHO made that clear in 2005, and they can’t be too supportive of the powerful. BHO voted against Alito and Roberts based on those criteria. If the press is to be believed (not always, but now and again they get it right), BHO is not concerned with the judicial qualifications of his nominee. He is looking for a political nominee to a supposedly non-political role. He is searching for someone to perpetuate his liberal legacy after he has moved on from the presidency. Obama will nominate a left-wing liberal that will support his vision of death (abortion), Socialism, and government expansion that is the core of his agenda. He will nominate a King or Queen to take his place when he is gone, because power is what drives Obama and his party. Just as Roberts and Alito were a reflection of Bush’s views, this new SCOTUS pick by Obama will reflect his extreme left-wing views.
